Refinancing

Refinancing​

A refinance is essentially changing your home loans from one lender to another, often to get a better interest rate, or to increase your borrowing.

​

To do this, your new lender sends your lawyer your new loan documents, we meet to sign these, and sign forms letting me register the new mortgage. I let your old lender know that we are changing to a new lender. They tell me how much you need to repay, and give me permission to remove your old mortgage. On the settlement day, I handle the money coming from the new home loan, repaying the old home loan, and changing around who the mortgagee is on your property's title.

My fee estimate for a simple refinance (a personally owned freehold property refinancing from one bank to another) is $1,150 incl GST plus disbursements (approximately $295, based on $260 in LINZ search and registration fees and $35 in AML check fees).

​

Fees can be more if you have a more complicated situation, such as dealing with a non-bank lender, dealing with more than one bank or property, or if properties are owned by companies or trusts.

Property transfers

Transferring a property 

Many people wish to transfer properties they already own into the ownership of a company, trust, or joint ownership with their partner for a number of reasons.

​

There are different ways you can do this, but it will generally require new loan documents and mortgage registrations, meaning you need a lawyer involved.

​

Each side of the transaction should generally get independent legal advice, but if there is a negligible risk of a conflict of interest arising, some clients decide to instruct one lawyer to complete the conveyancing.
